1. Who we are

These Terms govern your use of SetupVerdict ("SetupVerdict", "the Platform", "we", "us"), available at setupverdict.com. You can reach us at support@setupverdict.com.

SetupVerdict is an independent product. It is not affiliated with, endorsed by or sponsored by any exchange or data provider. Third-party names are trademarks of their respective owners.

2. Acceptance of these Terms

By creating an account, using the free tool or buying Pro, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

You must be at least 18 years old and legally able to enter into a contract. You must use the Platform in accordance with the laws of your country (see section 19).

3. The service

• Free plan: a simplified bias (VWAP + EMA 9/21) for one pair at a time, with reference levels and a basic calculator.
• Pro plan: the full rule-based engine (10 indicators grouped into 5 checks), the LONG / SHORT / EARLY / WAIT / NO TRADE verdict, a 0–100 setup score, 4H and 1D analysis, the market scanner, the trade and position-size calculator, and the guide.

SetupVerdict only analyzes data. It does not connect to your exchange account, never asks for your exchange API keys, does not hold or move your money, and does not place orders. Every trading decision and every order is yours.

4. Educational use only — not financial advice

Everything on the Platform — verdicts, scores, levels, scanner results, calculator figures, guides and examples — is provided for educational and informational purposes only.

• It is not financial, investment, tax or legal advice, and not a personal recommendation to buy, sell or hold any asset.
• It does not take into account your finances, goals, experience or risk tolerance.
• SetupVerdict and the people behind it are not licensed financial advisors, brokers, portfolio managers or investment firms in any jurisdiction.
• A verdict describes what fixed technical rules say about past price data at the close of a candle. It is not a forecast and not a promise of what the price will do.
• The setup score shows how many conditions line up. It is not a probability of winning or an expected return.
• A SHORT verdict describes a bearish setup. On a spot market you cannot open a short position; shorting requires margin or futures, which carry additional costs and liquidation risk and are not suitable for most beginners.

5. Risk warning — no guarantee of profit

We do not guarantee any profit, any result or any win rate. Crypto-assets are highly volatile and largely unregulated. You can lose part or all of the money you trade.

• Past behaviour of any indicator, rule, example or backtest does not guarantee future results. SetupVerdict does not publish performance claims.
• Calculator figures are estimates based on the levels shown. They exclude trading fees, spreads, slippage, funding and price gaps. A real loss can be larger than shown — for example when price jumps past a Stop Loss.
• Levels are calculated on the close of the last finished candle; the live price may differ. Always check the live price before acting.
• Leverage, margin and futures multiply both gains and losses and can lead to liquidation.
• Only trade money you can afford to lose. You alone are responsible for your decisions and their results.

6. Market data

Prices and candles come from third-party market data sources. We do not control that data. It may be delayed, incomplete, interrupted or inaccurate, and markets may be added, suspended or removed by their providers at any time.

All calculations run on that data as received. We are not responsible for errors, outages or changes on the data provider's side, or for the consequences of decisions based on such data.

7. Pro access & payment

• Pro costs a one-time payment of $49 USD (or the price shown at checkout at the time of purchase). There is no subscription and no recurring charge.
• Payments are processed by Stripe. We never see or store your full card details. Any taxes that apply are shown at checkout.
• Pro is linked to the SetupVerdict account you are logged into when you pay. It is activated automatically once Stripe confirms the payment, usually within seconds.
• A Pro licence is personal: one person, one account. It may not be shared, resold or transferred.
• Updates and improvements we release to Pro are included at no extra cost. We may also change, replace or retire individual features over time (see section 13).
• If a payment is reversed, refunded or charged back, Pro access may be removed.

8. "Lifetime" access — what it means

"Lifetime" means for the lifetime of the SetupVerdict platform, not your lifetime or any fixed number of years. Your Pro access does not expire with time and you will never be asked to pay again for it. It continues for as long as the Platform operates and the third-party services it relies on, such as market data providers, remain available.

Your access can also end earlier if you breach these Terms (section 17) or delete your account.

9. Right of withdrawal & refunds

Pro is digital content supplied immediately after payment. If you are a consumer in the EU/EEA or the UK you normally have a 14-day right of withdrawal for online purchases. Before you pay, we ask you to expressly agree that access starts immediately and to acknowledge that you thereby lose your right of withdrawal. Pro cannot be bought without this confirmation, and once access has been provided the right of withdrawal no longer applies.

For this reason all sales are final and we do not offer refunds for change of mind, for trading results, or because markets did not produce setups.

This does not limit the rights you have by law if the digital content is faulty or not supplied. If you paid and Pro does not work for you, contact support@setupverdict.com. We will first fix the problem; if we cannot make Pro available to you within a reasonable time, you will be entitled to the remedies mandatory law gives you, which may include a refund.

10. Your account

• Give accurate information and keep your email address up to date — it is how we confirm your account and contact you.
• Keep your password confidential and do not share your account. You are responsible for activity under your account.
• Tell us right away if you think someone else has accessed it.
• One account per person. Creating several accounts to get around limits is not allowed.

11. Acceptable use

You agree not to:

• resell, publish, broadcast or redistribute Pro output (for example as a paid signal group or channel) without our written permission;
• copy, decompile or reverse-engineer the Platform to build a competing product, or remove copyright notices;
• bypass or attempt to bypass authentication, payment or access controls, or access other users' data;
• use bots, scrapers or automated mass requests against the Platform, or do anything that overloads or disrupts it or the data providers it uses;
• use the Platform for anything unlawful, fraudulent or market-abusive.

12. Intellectual property

The Platform, its code, design, texts, logos, guides, videos and the way the rules are combined belong to SetupVerdict or its licensors and are protected by copyright and other laws. Buying Pro gives you a personal, non-exclusive, non-transferable licence to use it for your own purposes while your access lasts. Nothing else is transferred to you. Market data belongs to its provider.

13. Availability & changes to the service

We aim to keep SetupVerdict available around the clock but we do not guarantee uninterrupted or error-free operation. It may be unavailable because of maintenance, updates, problems with our hosting, authentication or payment providers, the data provider, your network, or other events outside our control.

We continuously improve the Platform and may change indicators, rules, thresholds, timeframes, pairs, design and features. We will not deliberately remove the core of what Pro is — the rule-based analysis engine, the scanner and the calculator — while the Platform operates, except where this is required by law, by a provider (for example the data source) or for security reasons.

14. No warranty

To the extent permitted by law, the Platform is provided "as is" and "as available". We do not warrant that it will meet your expectations, that any analysis or data is accurate, complete or current, that it will be free of bugs, or that using it will lead to any particular result. Your statutory rights as a consumer are not affected.

15. Limitation of liability

To the maximum extent permitted by applicable law:

• we are not liable for any trading or investment losses, lost profits, missed opportunities, or indirect or consequential damages arising from your use of, or reliance on, the Platform, its data or its output;
• we are not liable for losses caused by third parties, including exchanges, data providers, hosting, authentication or payment providers;
• our total liability to you for any claim related to the Platform is limited to the amount you paid us for Pro (or USD 49 if that is higher), or to zero if you only used the free plan.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for intent, gross negligence, or death or personal injury caused by negligence, or your mandatory rights as a consumer.

16. Indemnity

If you use the Platform in breach of these Terms or the law (for example by redistributing Pro output or attacking the service) and this leads to claims against us, you agree to cover the resulting reasonable costs and damages, to the extent permitted by law.

17. Suspension & termination

You may stop using SetupVerdict at any time and ask us to delete your account. Deleting your account ends Pro access permanently.

We may suspend or close an account, without refund, if it is used in serious or repeated breach of these Terms — for example account sharing, reselling output, fraud, chargeback abuse or attacks on the Platform. Where reasonable, we will warn you first and give you the chance to stop.

18. Changes to these Terms

We may update these Terms, for example when the service, the law or our providers change. The current version is always published on this page. For material changes affecting Pro users we will give notice on the website or by email before they take effect. If you keep using the Platform after a change takes effect, the new Terms apply. Changes do not take away Pro access you have already paid for, except as described in section 8.

19. Local laws & disputes

Use SetupVerdict responsibly and in accordance with the laws of your country. You are solely responsible for making sure that using a crypto analysis tool, and buying, selling or trading crypto-assets, is legal where you live, and for any taxes or reporting obligations that apply to you. Do not use the Platform where this is prohibited.

20. General

• If any part of these Terms is found invalid, the rest remains in force.
• If we do not enforce a right immediately, we have not waived it.
• These Terms and the Privacy Policy are the entire agreement between you and us about the Platform.
• We are not responsible for delays or failures caused by events beyond our reasonable control (force majeure).
• We may transfer this agreement to a successor that continues to operate the Platform; your rights under it will not be reduced as a result.
• These Terms are written in English. Translations, if any, are for convenience; the English version prevails to the extent permitted by law.
